CORE SUBJECT
Death sentence for defendants in kidnapping and assault of a minor in Alexandria
The Alexandria Criminal Court, headed by Judge Hani Kamal Gabriel, sentenced today, Sunday, both "M.A.A" and "H.A.H", unemployed, to death by hanging unanimously; following the issuance of the religious opinion by the Grand Mufti of the Republic; for their charge of kidnapping a girl named "S.H.A", 17 years old, a student, and assaulting her under threat of a weapon.
The case, registered under number 25446 for the year 2024 at the First Al-Montazah Criminal Court, dates back to the Alexandria Security Directorate receiving a report from the mother of a girl accusing two persons of kidnapping and assaulting her within the jurisdiction of the police department.
Investigations supported by police inquiries and witness testimonies revealed that while the victim was walking on a public road to buy some food for her family, the first defendant, who had a friendship relationship with her, stopped her and asked her to walk with him. During their walk, he contacted the second defendant, and they stopped a "tuk-tuk" vehicle under the pretext of taking her home, without her knowledge that they had prepared a residential apartment belonging to one of their friends to lure her there.
The investigations, reinforced by the review of surveillance camera footage in the area, showed that upon reaching the bottom of the building where the incident occurred, the first defendant brandished a knife in front of the victim, threatening her, which instilled fear in her and paralyzed her resistance. Using this method, he managed to pull her and take her up to the apartment unit.
The investigations also revealed that the victim received a phone call from her mother at that time, but the first defendant prevented her from answering. Then the two defendants took turns assaulting her and violating her honor by force "under threat". After the apartment owner arrived, they released her, and she returned to her family.
Following proper procedures and the arrest of the defendants, a report was filed about the incident. Upon presenting it to the Public Prosecution, they decided to detain the defendants pending investigations until they were referred to the Alexandria Criminal Court, which issued the aforementioned ruling, with the membership of judges Mahmoud Al-Sharbini, Mohamed Abdel Fattah, Mohamed Abdel Maqsoud Qantoush, the head of the First Amreya Prosecution Mahmoud Ghali, and the court secretary Ahmed Al-Sayed.
